There are involved in this-appeal only the rights -as between the appellee bank and the appellant F. C. Hirt. For more than twenty years, the appellant has been a stockholder in and director of the bank. The action, in so- far as the matters herein involved are concerned, is founded' upon three promis- ■ sory notes signed by the appellant. It is apparent' that, at the time of the execution of said notes, there were grave fears in the minds of the directors of the bank as to its being able to weather the storm which in recent years has caused receivership proceedings over many of our banking…
