On March 23, 1897, Frank Beranek, plaintiff’s husband, took a lease of a vacant lot in the city of La CroSse from the defendant John Beranek, his father. The lease was in the usual form, for a term of five years, and the rent to be paid was the taxes on the property.

Under our statute (sec. 2983, Stats. 1898), there can be no doubt but that a homestead may be secured in premises held under a lease. It is also true that, in so far .as leased property is susceptible of being conserved as a home, it is governed by the same rules that apply to homesteads based upon property held by more enduring titles.
