NEWMAN, District Judge.

This suit was brought originally in the state court by the plaintiff against the Southern Railway Company and Charles E. Perkins and John E. Chestnut, the engineer and conductor, respectively, of the train which it is alleged killed the plaintiff’s husband. The case was removed by the defendant the Southern Railway Company, a nonresident corporation (the two individual defendants being citizens and residents of this district), to the Circuit Court of the United States, on the ground of a separable controversy between it and the plaintiff.
