JOURNAL ENTRY and OPINION

Defendant-appellant, Richard Davet, appeals from the trial court's entry of summary judgment in favor of defendant-appellee, Bank One Cleveland, N.A (hereinafter appellee). Because our review of the record compels us to conclude that the order appealed from is not a final order under Civ.R. 54(B), we hereby dismiss the within appeal. In doing so, we acknowledge that there are legitimate issues presented in assignments of error I, II, and III.
