JACOBS, Justice:

Glenn T. Winer (“Winer”), the defendant-below, appeals from the denial by the Superior Court of his motions to sever and for a judgment of acquittal. Winer was indicted on charges of first degree arson and criminal mischief (damaging tangible property in an amount less than $1,000), but was found guilty of third degree arson (a lesser-included offense) and criminal mischief. On appeal, Winer claims that the trial court erred in: (1) denying his motion for a judgment of acquittal; and (2) refusing to sever for trial the criminal mischief charge from the arson charge. We…
