The plaintiff in error, hereinafter in this opinion referred to as the defendant, was convicted as an habitual violator of the prohibitory liquor laws of the state of Oklahoma, for having possession of intoxicating liquor with intent to barter, sell, give away, or otherwise furnish to others, and sentenced to three years in the state penitentiary and to pay a fine of $300. Motion for new trial was filed, considered, and overruled, and the defendant prosecutes this appeal by petition in error with case-made attached.
