MILLER, Judge.

This case is before the court on defendant’s motion to dismiss or, alternatively, for judgment upon the administrative record. Alleging violations of 10 U.S.C. §§ 624, 632, 642, and 1174 (2000), plaintiff seeks military separation pay based on his separation from the United States Department of the Navy (the “Navy”). Plaintiff specifically alleges that the Navy violated its own procedures for delaying promotions and denying a promotion to which he claims entitlement.
