Terry W. Ellerman, formerly a fireman employed by relator, filed a petition in the circuit court of Christian County seeking review of a decision of the Springfield Personnel Board which affirmed his dismissal for “conduct unbecoming an officer or employee of the city.” Apparently Ellerman had been convicted of manufacturing marijuana. Relator filed a motion to dismiss that petition on two grounds; (1) improper venue, and (2) because Ellerman had later filed another petition for review in the Circuit Court of Greene County.
