Immediately prior to the thirtieth day of November last Prank Thomas tendered to the city treasurer of Missoula one-half of the 'amount of taxes levied upon his property by the city for the year 1923. The tender was refused and upon the threat of the treasurer to sell the property for delinquent taxes unless the entire amount were paid by 6 o’clock P. M. of November 30 this action was instituted to secure an injunction restraining the city and its treasurer from proceeding to carry the threat into execution.
