*644Henry Moats brought an action .of trespass on the ease for malicious prosecution in the circuit court of Ritchie county claiming $10,000.00 damages against William M. Rymer. The case was tried by a jury and a verdict found for the defendant, upon which judgment was entered, for him. From this judgment the plaintiff obtained a writ of error and supersedeas to this Court.
