The defendant, now serving a five-year sentence at Lewisburg Penitentiary imposed by the late Judge William B. Herlands following his conviction of perjury, moves for a new trial upon a claim of newly discovered evidence pursuant to Rule 33 of the Federal Rules of Criminal Procedure.
