WEST, District Judge.
Two actions by husband and wife were consolidated and tried together. Originally they were for the fraudulent conversion of notes or their proceeds, the notes alleged to have been sold to plaintiffs by defendant or its predecessor the Knoxville Savings Bank, acting through one JIaun, who was eashier of both institutions, and held for collection as shown by receipts made out on hank stationery, executed by the cashier.
