OPINION

WALKER, Chief Justice.

Appellant was convicted by a jury for having committed the misdemeanor offense of driving while intoxicated. The trial court assessed punishment at two years’ confinement in the Montgomery County Jail, and a fine of $700. The trial court suspended the imposition of the jail sentence and placed appellant on probation for a period of two years. The record before us reflects the offense date to have been on or about August 10, 1992. The trial commenced on October 24, 1994.
