FEINBERG, District Judge.
Libelant, Willie Irving Taitón, while a passenger aboard respondent’s vessel, the S.S. United States, was injured under the circumstances set forth below. The action is in admiralty, and I find that this Court has jurisdiction over the parties and subject matter of the action.
On December 1,1957, some time before dawn, Mr. Taitón arose from his bunk and walked to the bathroom which he shared with three other passengers in cabin B-137. The vessel was passing through rain squalls and was rolling and pitching in a moderate sea. As Mr. Tai-tón approached the lavatory door,…
