Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which found petitioner guilty of violating certain prison disciplinary rules.

Petitioner became loud and disruptive during an interview with a sergeant against whom he had filed five grievances. As a result, he was charged in two misbehavior reports with harassment, lying, interfering with an employee, refusing a direct order and making threats.
