MEMORANDUM OPINION

This case comes before the court on cross-motions for summary judgment and plaintiff’s “Motion to Dismiss Marie Therese Zenda’s Special Defenses and Counterclaim.” A virtual avalanche of motions, cross-motions, affidavits, counter-affidavits, amended pleadings, requests for admissions and production of documents, and interrogatories have been filed by the parties. The complaint alone has been amended no less than twice.
