The matter for determination by this court arises from a motion for summary judgment in an action in assumpsit. The suit is upon an insurance policy issued to plaintiff by defendant. The critical dates appear to be June 1, 1967, which each party agrees is the effective date of the policy, and the date when plaintiff either received treatment or a recommendation for treatment by a legally qualified doctor of medicine or osteopathy.
