This case is bere upon a writ of error from the judgment of the judge of the superior court, overruling a demurrer. It appears from the record, that under the general act for the incorporation of railroads, approved October 21st, 1891, a charter was granted to the Florida & Northern Railroad Company. Its charter was afterwards amended under the general act approved December 17th, 1892, it thereby obtaining all the rights which might accrue to, and subjecting itself to all the liabilities imposed upon, railroads chartered under that act.
