Defendant Dwayne Chaney was charged in a six-count indictment with two counts of unlawful possession of a weapon by a felon (720 ILCS 5/24 — 1.1 (West 2004)) and four counts of aggravated unlawful use of a weapon (720 ILCS 5/24 — 1.6 (West 2004)). Due to his prior criminal history, the charges against him constituted Class 2 felonies. Following a bench trial, defendant was convicted on two counts of unlawful use of a weapon by a felon and two counts of aggravated unlawful use of a weapon, which were merged with the first two counts.
