*1043Appeal from a judgment of the Supreme Court, Erie County (Penny M. Wolfgang, J.), rendered January 6, 2004. The judgment convicted defendant, upon a jury verdict, of murder in the second degree (two counts), attempted murder in the second degree, criminal possession of a weapon in the second degree (three counts) and criminal possession of a weapon in the third degree (four counts) and, upon his plea of guilty, of criminal possession of a weapon in the third degree.

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.
