GANTMAN, J.:

¶ 1 Appellant, Chris Falcone, Inc., appeals from the order entered in the Philadelphia County Court of Common Pleas, granting summary judgment in favor of Appellee, Insurance Company of the State of Pennsylvania, and dismissing Appellant’s complaint with prejudice. Specifically, Appellant asks us to determine whether the trial court erred when it dismissed Appellant’s complaint because Appellant had not promptly transferred its federal case to state court in compliance with the Pennsylvania transfer statute at 42 Pa.
