Appellee brought this suit against appellant for the recovery of $1,000 and interest, alleging that theretofore, on the 15th of August, 1906, he and appellant had entered into a written contract, whereby appellant agreed to- sell to him, for delivery on the first of October, 1906, one hundred head of cows and one hundred head of calves, out of certain specified brands, for the sum of $20.25 for each cow and calf so delivered, said cattle to be good, smooth, merchantable cattle; that appellee paid to appellant, in part payment thereof, the sum of $1,000; the balance of…
