1. Plaintiff alleged, in substance, that on September 9, 1909, he was a switchman in the employ of defendant in the yards at Taylor, Tex.; that defendant and his agents and representatives, whose duty it was to exercise ordinary care to keep said yards reasonably safe for the performance of plaintiff’s duties, negligently failed to discharge such duty, but. permitted said yard and roadbed to be and continue in a dangerous condition by reason of the accumulation of clinkers and rocks thereon, and that plaintiff on said date, in the performance of his duties, was…
