. MEMORANDUM AND ORDER DENYING MOTION TO DISMISS
THORNTON, District Judge.
A motion to dismiss this cause for lack of subject matter jurisdiction has been filed by defendant herein and argued and briefed by counsel for the respective parties. The factual background of this suit may be succinctly set forth by quoting from a motion for par tial summary judgment heretofore filed by plaintiff:
