Tbis action results from a collision between a railroad train and a motor truck loaded witb lumber, wbicb collision occurred at Stillwell Avenue crossing in tbe city of DeQueen, about 11 a.m., June 22, 1943. Appellee, Melvin Mickel, tbe driver of tbe truck, instituted action against appellant, Tbe Kansas City Southern Railway Company, to recover damages for personal injury allegedly sustained by bim, and be and bis mortgagee, Horatio State Bank, instituted action to recover alleged damage to tbe truck.
