This appellant was convicted upon an indictment charging him with embezzlement, fraudulent conversion, and wilful misapplication of funds of the trust company of which he was the president and a director.

The first and second counts of the indictment are drawn under section 1 of the Act of June 12, 1878, P. L. 196 (18 PS §2511), and the third count of the indictment is drawn under section 1 of the Act of April 23, 1909, P. L. 169, prior to its amendment by section 1 of the Act of April 16, 1929, P.
