OPINION AND ORDER

Pending before the Court is Defendant J.C. Penney Puerto Rico, Inc.’s Motion to Dismiss. (Docket No. 11). For the reasons set forth below, the Court GRANTS in part and DENIES in part Defendant’s Motion.
FACTUAL AND PROCEDURAL BACKGROUND
According to Carlos L. Gonzalez Figueroa, on June 2005, his employer offered him a Hobson’s choice: to either accept a retirement or be demoted. (Docket No. 1). On September 18, 2005 Carlos L.
