Affirming.

The determinant question presented by this appeal is one of fact, and since the facts are not disputed, therefore it becomes one of law. Consolidated Coal Company y. Ratliff, 217 Ky. 103, 288 S. W. 1057; Warfield Natural Gas Co. v. Muncy, 244 Ky. 213, 50 S. W. (2d) 543.
