This matter is before the Court on the defendant’s Motion for Summary Judgment as to the plaintiff’s copyright claims. The copyright count of the Complaint alleges that A1 Nyman & Sons, Inc., (“Nyman”) has reproduced or had reproduced on its behalf eyeglass displays in violation of the plaintiff’s exclusive rights therein under the Copyright Act of 1976, Title 17 of the United States Code. Nyman argues in connection with its present motion that the eyeglass displays are industrial designs which are uncopyrightable as a matter of law. For the reasons…
