Martin, J.:
The city chartered the scow Eastman No. 3 from the owner, F. P. Eastman, on October 24, 1919. With the scow Eastman furnished a' crew consisting of a. captain and a mate. The city also engaged, a contractor to furnish labor to trim garbage and assist in the shifting of the scow when necessary.
The relationship between the city and the contractor on the one hand, find the city and the scow owner on the other, is fully set forth in letters exchanged between the parties. Counsel stipulated that these letters constituted the agreement between the parties. In the letter of November 5,…
