MEMORANDUM

JOHN T. NIXON, Chief Judge.

The Court is in receipt of Motions to Dismiss or For Summary Judgment filed in the above-styled action by Vanderbilt University (Doc. No. 135) and the Rockefeller Foundation (Doe. No. 156). Upon consideration of the record and oral argument conducted regarding these Motions, the Court concludes that Defendants’ Motions lack merit. Accordingly, the Court denies Defendants’ Motions.
