This action was instituted by the plaintiffs in the court below for the purpose of foreclosing mechanics’ and material men’s liens upon two lots situated in the city of Omaha, Nebraska. The record title to these lots was in defendant Mary A. Wallace, and Daniel W. Ryckman was in possession of the lots in controversy under an execu-tory contract for the purchase thereof.
