I. STATEMENT OF CASE

The plaintiff-appellant, Landmark Enterprises, Inc., a Nebraska corporation, challenged in the Nebraska Court of Appeals the district court’s dismissal of this action to foreclose the construction lien Landmark filed against premises owned by the defendant-appellee M.I. Harrisburg Associates, a Nebraska partnership.
