I. PROCEDURAL HISTORY

Plaintiffs William J. Rutkowski and Janet Rutkowski commenced this suit against their insurance carrier, Allstate Insurance Co., alleging breach of contract and bad faith liability in connection with Rutkowski’s prop*12erty damage claim for his 1997 Mercury Cougar. (See dkt. entry no. 1.) On April 21, 2004, Rutkowski withdrew the breach of contract claim and proceeded to trial solely on the bad faith claim under 42 Pa.C.S §8371.1 (Id., no. 24.)
