This matter comes before the Court on the plaintiffs Motion to Remand [docket entry no. 3]. Having reviewed the motion, response, rebuttal, briefs, applicable statutory and case law and being otherwise fully advised as to the premises, the Court finds as follows:

FACTS

On December 19,1997, Ray Charles Als-worth obtained a home loan from the Mississippi Veterans Home Purchase Board to purchase a house in Jefferson County, Mississippi. That same day he executed a note and deed of trust in favor of the Purchase Board. At all relevant times, the house was…
