OPINION BY

POPOVICH, J.:

¶ 1 The Commonwealth appeals the order granting the pretrial motion to suppress and writ of habeas corpus of Ruba Jackson/Appellee. We affirm.

¶ 2 The facts, as is herein relevant and recited in the suppression court’s opinion, show the following events leading to the present appeal; to-wit:... Sometime during Saturday, May 26, 2000, Mrs. Jill Kraemer, a postal worker for the Mohnton Post Office, supposedly first noticed a tape recorder which had been on the Defendant’s ... desk for years. The Defendant is ... the Postmaster for the Mohnton Post Office....
