Jack Casperson, Bernard Philip Pletcher, Ronald A. Sablosky, and Gerald Ruis appeal from their convictions for violations of 18 U.S.C. §§ 371 (conspiracy), 1341 (mail fraud), 1343 (wire fraud), and 2314 (inducing interstate travel to defraud). For reversal, appellants challenge the district court’s failure to give a “good faith” or theory of defense instruction. In addition, Ruis challenges the sufficiency of the evidence supporting his conviction; Casper-son, Pletcher, and Ruis claim that the doctrine of merger bars their conviction on both the substantive counts…
