Appeals by tile defendants, Levi P. Morton and others, from an interlocutory judgment of the- Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 17th day of May, 1907, upon the decision of the court, rendered after a trial at the New York Special Term, overruling the said defendants’ demurrers to the amended complaint.

This action is brought by the Attorney-General in the name of the People, pursuant to the provisions of sections 1781 and 1782 of the Code of Civil Procedure, against former and present directors *718of the Equitable Life Assurance Society of the tlnited States, to require them to account for their official conduct in the management and disposition of the funds and property committed to their charge as directors',, and to compel them, to pay to.the society'any money and the value of any property which they or any of them have acquired to themselves, or transferred to others, or lost…
