This appeal arises out of a construction contract dispute between Allgood Electric Company (“Allgood”) and Martin K. Eby Construction Company, Inc. (“Eby”). On March 12,1993, Allgood, an electrical subcontractor for a building project, filed suit in the Superior Court of Dooly County, Georgia against Eby, the contractor, and Eb/s sureties, Federal Insurance Company (“FIC”) and Fidelity & Deposit Company of Maryland (“FDCM”). 1 The defendants subsequently removed the case to the United States District Court for the Middle District of Georgia predicating jurisdiction on diversity of…
