MEMORANDUM OPINION

ERWIN, District Judge.

This matter is before the court on defendant’s motion to dismiss for lack of subject matter jurisdiction pursuant to Rule 12 of the Federal Rules of Civil Procedure. Plaintiff, a citizen of North Carolina, has brought suit in federal court alleging alienation of affections and criminal conversation with jurisdiction based on diversity of citizenship between the parties.
