1. mortgage : absolute conveyance. The decision of this case turns upon the facts. In the view we take, no disputed question of law arises. We will proceed to give a statement which will set forth the facts, as we find them from the evidence, embodied in the record. the evidence is voluminous, and a great amount of matter is contained in the depositions that is irrelevant and no little that is incompetent.
