ORDER DENYING WITHOUT PREJUDICE MOTION FOR CITATION OF CRIMINAL CONTEMPT

THIS MATTER comes before the Court pursuant to the Motion for Citation of Criminal Contempt (the “Motion”) filed June 9, 2004, by Ronald J. Saffa (“Saffa”), plaintiff herein. In the Motion, Saffa requests that the Court find Stephen P. Wallace (“Wallace”), defendant herein, in criminal contempt for violating a permanent injunction entered in the above referenced adversary proceeding.
