H. C. Woolard sued G. W. Sizemore Sr. and G. W. Sizemore Jr., on a conditional-sale note and contract. Subsequently to the filing of the bill of exceptions, the plaintiff, Woolard, died; and his administratrix has, by proper order, been made defendant in error in his place. The contract of purchase between the parties, which is attached to the declaration, was dated April 17, 1905, and provided for the payment by the Sizemores to Woolard of $1,200, in three equal payments, the last payment being due December 1, 1905.
