Charles Cooper petitioned for a writ of habeas corpus, alleging that the jury instructions on the issue of intent used at his trial violated his due process rights. See Sandstrom v. Montana, 442 U.S. 510, 99 S.Ct. 2450, 61 L.Ed.2d 39 (1979). Mr. Cooper was convicted of attempted murder and armed robbery after a jury trial in circuit court for Racine County, Wisconsin; a judgment of conviction was entered on May 17, 1976.
