In this expropriation proceeding defendant-landowner appeals from a judgment of the district court urging that the trial judge erred in permitting plaintiff to expropriate a servitude 30 feet in width across her property, in failing to consider as compar-ables for severance damages sales by defendant of servitudes over the same and a neighboring tract, and that the amount awarded as severance damages was inadequate. Plaintiff’s answer to the appeal seeking reversal of the trial court’s decision awarding severance damages is questioned by defendant as to timeliness. The result…
