OPINION

COHEN, Justice.

A jury convicted the appellant of delivering more than one-fourth of an ounce but less than four ounces of marijuana and assessed punishment at five years imprisonment and a $2,500.00 fine.

A recitation of the facts is necessary for an understanding of the grounds of error. Around noon on September 2, 1982, one Bubba Humble came to the appellant’s apartment in order to settle a $60.00 debt he owed the appellant.
