OPINION OF THE COURT

Casey, J.

In 1957, following the purchase of premises located at 2432 University Avenue in The Bronx, plaintiff and Joseph Klein (hereinafter decedent) formed defendant Beverly Holding Company, a partnership, whose sole asset was the Bronx property which contained apartments. In 1967, plaintiff and decedent obtained two bonds from National Savings Bank of Albany (hereinafter the bank), totaling $189,000, which were secured by two 10-year mortgages on the Bronx property. *329Decedent died intestate in 1970, resulting in one half of his 50% ownership in the Bronx property passing…
