The cause is before the Court on the defendant United States’ motion for judgment, filed October 29, 1996 (Docket No. 47), and response thereto, filed November 8, 1996 (Docket No. 53).

PROCEDURAL BACKGROUND

The plaintiffs, Paul A. Bilzerian and Terri L. Steffen, commenced this action on June 13, 1994, by filing a two (2) count complaint: Count I — claim for damages pursuant to 26 U.S.C. § 7432 and Count II — claim for preliminary and permanent injunction (Docket No. 1).
