The appellant, Ronald C. Hutchinson, appeals from the district court’s order granting a new trial following a jury verdict in Hutchinson’s favor. The court ordered the new trial on two grounds: (1) the verdict was against the weight of the evidence and (2) the damages were excessive. Subsequently, the court dismissed the action when informed by counsel that Hutchinson was financially unable to pursue a second trial.
