Presently before the Court in this case is Plaintiffs’ “Motion to Compel Discovery from Non-Party Witness” and a supporting Brief filed pursuant to Rule 37, Federal Rules of Civil Procedure, wherein Plaintiffs seek an Order from the Court requiring John W. Gardner (Gardner), a non-party to this action, to answer certain questions posed to him during his deposition taken on behalf of Plaintiffs on April 26, 1979.
